Terms and Conditions: Embark Travel Ltd

All purchases and tours booked through this website, via email or over the telephone are subject to the following Terms and Conditions. In any and all bookings, the person making the booking shall be deemed to have accepted these conditions on behalf of the guest(s) named in the booking. No variation to these Terms and Conditions shall be of any effect unless made in writing by and with the authority of the company.

Payments:

Embark Travel Ltd is able to accept the following payment methods: Mastercard, Visa, American Express and Paypal.

Embark Travel Ltd requires a £50 pp non-refundable deposit upon confirmation of the booking and full payment within 6 weeks of departure. (Full payment will be required if booking with 6 weeks of the departure date.) Your payment will be noted on your card as SQ* EMBARK TRAVEL.

All tours are fulfilled and provided by Embark Travel Ltd. Elements of your tour (accommodation, evening meals etc.) may be provided by third parties under a contract with Embark Travel Ltd.

By confirming a booking all guests submit 100% compliance to the following Terms and Conditions policy. Should any doubt or dispute with said Terms and Conditions arise before booking, guests are requested to contact the company before confirming a booking.

Deposit Payment:

Due to the complex planning, logistics, ticket issuing and accommodation requests that go into guests’ tours, Embark Travel cannot guarantee any booking without payment of a deposit (or full payment if booked within 6 weeks of departure.) lease double check all details of your quote and proposed itinerary before confirming your booking and paying your deposit.

Currency:

Tours listed and proposed quotes sent to the guest are priced in GBP. All booking and payments are processed in GBP.  Guests accept any and all fee associated with booking tours/services using a credit card. 

Delays on tours/Transfer Services:

Upon confirmation of your booking, you will receive a finalised itinerary detailing your meeting point and time.  Guests are asked to arrive at the meeting point for the specified time prior to the start of the tour. If you or your travel companions are running late or need assistance finding the meeting point, please call the number provided in your confirmation documents and we will do our best to assist you, however, it is your ultimate responsibility to reach a meeting point on time. Embark Travel Ltd is not responsible for the failure to arrive at a tour meeting point on time. Please see the No show/late arrival clause on the cancellation policy.

Cancellations and Cancellation Policy:

Cancellation by the Customer:

Cancelling or amending a booking with Embark Travel Ltd may result in cancellation/amendment fees being applied by Embark Travel Ltd as outlined in the below cancellation policy.

Any cancellation/amendment must be communicated via e-mail to emma@embarktravel.co.uk. We are unable to accept cancellations via Facebook Messenger or post comments.

A booking is considered successfully cancelled or amended only after Embark Travel Ltd send successful notifications via email and cancellation/amendment fees are assessed.

The customer will be charged on the following basis:

  • Deposits are non-refundable for all walks and tours. (In some cases we may be able to transfer the deposit to another tour/date – this can be discussed on a case by case basis.)

  • 50% of the total fee where cancellation takes places less than four weeks but more than two weeks before the commencement date of the tour.

  • 100% of the total fee where cancellation takes place less than 2 weeks before the commencement of the tour or in case of a no show.

We may be able to move your booking to another date with adequate notice depending on availability. Please contact us at emma@embarktravel.co.uk if you have any questions.

We strongly advise that you take out cancellation insurance for your trip in case you need to cancel due to medical reasons, weather or unforeseen circumstances.

 

Cancellation by Embark Travel Ltd: (Reasons not related to extreme circumstances.)

If Embark Travel Ltd need to cancel a tour due to unforeseen circumstances or events, we will notify you as soon as possible. This may be due to circumstances out of our control.

If the tour is cancelled (not relating to weather/extreme circumstances) you will be offered:

  • The option to move the tour to another date.

  • The exact same tour on different dates or an alternative tour equal, at least, to monies paid.

  • Voucher to be used for another tour.

  • A full refund of monies paid.

Valid Identification:

Please ensure all members of your party have a valid ID with them on commencement of their tour. This is to ensure the successful check-in of accommodation for legal requirements.

Refunds on Unused Services:

All Embark Travel Ltd tours are sold as an entire package; as such there will be no offers of partial refunds for portions of a service that a guest has decided not to utilize.  If a guest has pre-purchased tickets to any sites visited, or tours or site visits similar to the tour booked from an outside vendor, Embark Travel Ltd is not responsible for the reimbursement of any such fee.

Travel Insurance:

Embark Travel Ltd strongly recommends guests arrange travel insurance to cover cancellations and delays due to unforeseen circumstances, or those beyond all control (e.g. inclement weather, strikes, seismic events, acts of God.) It is also recommended guests arrange medical and personal insurance to cover any medical expenses, loss of luggage, loss of personal belongings or other such travel mishaps. Guests agree both the company and any local partner operators (including accommodation and restaurants) are not liable for any of such unforeseen circumstances and hold all parties harmless.

Embark Travel will not be held liable for costs related to travel, food or accommodation if an event is cancelled for any reason.

 All claims of reimbursements for insurance must go directly through the insurance provider and not through Embark Travel Ltd or its affiliates.

We strongly advise you to take out insurance for the duration of your trip in respect of cancellation and curtailment, injury, death, lost baggage and money, liability, medical expenses and repatriation.

Embark Travel Ltd does not take responsibility if your selected insurance policy does not cover losses due to delates, cancellations, illness or medical expenses,

Liability:

Embark Travel Ltd as an event operator, is strictly limited.  Embark Travel Ltd purchases accommodation and other services from independent suppliers not under our control.  We carefully select our suppliers, but we serve only as an agent for them in securing tour arrangements. Therefore, we will not accept responsibility for wrongful, negligent or arbitrary acts or omissions of those independent contractors, their employees, agents, servants or representatives. 

Embark Travel Ltd will only be liable for loss or damage caused by our negligence or by that of someone employed by us. 

Embark Travel Ltd will not be liable for any injury, loss, damage or expense resulting from force majeure or any unforeseen circumstances beyond our control.

Safety:

Being on foot in remote and/or rugged country is potentially hazardous by its nature and participants must accept a certain element of risk. In the interest of safety, you must agree to abide by the decisions of your guide. As we have no control over weather conditions, we reserve the right to alter the itinerary accordingly. People whose fitness or ability is clearly at variance with the tour/route initially selected may need to undertake a different route/walk than that initially selected at the tour guides discretion.

Medical Conditions:
Please let us know, in confidence, of any conditions from which you suffer which may affect tour safety in remote areas. These include vertigo and diabetes.  Please consult your doctor before embarking on a walking tour if in any doubt.

 

Acknowledgement of Risk:

  • I agree that I will undertake any activities in accordance with the safety rules and advice that I receive before and during the activities I am undertaking. In addition, I agree to wear any safety equipment as instructed and checked by the tour leader.

  • I understand that the activities may include obstacles of a substantial and physically testing nature. I accept there is a risk of injury when undertaking such activities/walks.

  • I will at all times comply with the tour leaders directions and that I am responsible for my own safety before, during and after participating in the activities/the walk.

  • In the unlikely event of an accident or loss or damage to my personal effects, I acknowledge that Embark Travel Ltd will not be liable for any direct or indirect loss, damage or injury arising from, or in connection with, the activities/walks. (Except for death or injury caused by the company’s negligence.)

  • I certify that to the best of my knowledge, I do not have a medical condition which might have the effect of making it more likely that I will be involved in an accident which could result in injury to myself or others.

Email List:

When you place a booking with Embark Travel Ltd, we will ask you to provide an email address. Occasionally we will send you information about our guided walking tours and events that we think you might be interested in.  You can unsubscribe at any point and we will not pass your email onto any third parties.  If you prefer to receive these emails please let us know when booking or email us emma@embarktravel.co.uk and we will update your email preferences.

 

Complaints:

In the unlikely event that you have a concern on complaint during tour walking tour, this should be brought to our attention immediately so we can try and resolve the situation as soon as possible. Should it not be possible to settle the matter instantly, please write to us as soon as possible after your trip; a delay in doing so may lead to an inability to substantiate your claim.
